These Terms of Service govern your use of escapementtools.com and your purchase and use of software provided by Escapement Tools, operated by TD Cadworks Inc., an Alberta corporation based in Calgary, Alberta, Canada.
By accessing our website, purchasing a product, or installing or using Escapement Tools software, you agree to these Terms.
About Escapement Tools
Escapement Tools develops software utilities intended to improve workflows in Autodesk software, including Autodesk Civil 3D.
Escapement Tools and TD Cadworks Inc. are independent of Autodesk, Inc. References to Autodesk products are for compatibility and identification purposes only. Third-party product names and trademarks belong to their respective owners.
Purchases
Products, prices, supported software versions, licence types, and other product-specific information are displayed on the applicable product page or during checkout.
Prices are shown in the currency indicated at checkout. Applicable taxes and payment-processing details will be displayed as required.
Payment is processed through Squarespace and its payment-processing providers. Escapement Tools does not intentionally store your complete payment card number.
You agree to provide accurate and complete information when making a purchase.
Digital Delivery
Escapement Tools software is delivered electronically.
After a successful purchase, you may receive download, licence, activation, or other product information by email or through another electronic delivery method.
Delivery may occasionally be delayed by payment processing, email filtering, service interruptions, or automated fraud and security checks.
If you complete a purchase and do not receive the expected product or licensing information, contact support@escapementtools.com or 1-855-ETTOOLS (1-855-388-6657).
Software Licence
Purchasing Escapement Tools software gives you a licence to use that software subject to these Terms and any product-specific licence terms provided at the time of purchase or with the software.
Unless otherwise stated, your licence is:
Limited to the product and licence rights purchased
Non-exclusive
For lawful business or personal use
Subject to any applicable user, device, activation, or version limits associated with the purchased licence
You may not:
Sell, sublicense, rent, or commercially redistribute the software or licence unless we expressly permit it
Share licence credentials, activation information, or licence files with unauthorized users
Circumvent, disable, or interfere with licensing or activation systems
Copy or distribute the software except as reasonably necessary for authorized installation or backup
Reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits that activity
Remove copyright, trademark, licensing, or ownership notices
Use the software in violation of applicable law
Additional product-specific licence conditions shown during purchase or installation form part of these Terms.
Updates and Compatibility
Supported Autodesk products and versions are identified on the applicable Escapement Tools product page or documentation.
We may release maintenance updates, bug fixes, compatibility updates, or new product versions from time to time.
A purchase does not guarantee compatibility with future Autodesk releases, operating systems, third-party software, or future major versions of an Escapement Tools product unless expressly stated.
We may discontinue support for older software versions where reasonably necessary.
Your Responsibility for CAD Data
Escapement Tools products are productivity tools intended to assist experienced users of CAD and design software.
You are responsible for:
Maintaining appropriate backups of drawings, project files, and other data
Reviewing changes made by the software
Confirming that resulting drawings, models, calculations, quantities, geometry, or other outputs are appropriate for their intended use
Following your organization's quality-control, checking, and professional-review procedures
Determining whether a product is suitable for a particular project or workflow
Escapement Tools software is not a substitute for professional judgment, engineering review, design verification, or project-specific quality control.
Do not rely on Escapement Tools software as the sole basis for safety-critical or life-safety decisions.
Refunds and Purchase Problems
If you experience a problem with a purchase, licence, installation, or product, please contact us so we can attempt to resolve it.
Refund requests will be considered reasonably based on the circumstances of the purchase, the nature of the problem, whether the product has been delivered or activated, and applicable law.
Nothing in these Terms limits any cancellation, refund, warranty, or other consumer right that cannot legally be excluded or waived.

We aim to provide practical assistance with installation, licensing, compatibility, and product operation, but we do not guarantee a particular response or resolution time unless expressly stated.
Availability of Services
We try to keep our website, licensing systems, downloads, and related services available and reliable.
However, services may occasionally be unavailable because of maintenance, updates, third-party outages, internet problems, security events, or circumstances outside our reasonable control.
We may change, suspend, replace, or discontinue website features or supporting services where reasonably necessary.
Intellectual Property
The Escapement Tools website, software, documentation, graphics, branding, videos, text, and other original materials are owned by TD Cadworks Inc. or used with permission and are protected by applicable intellectual-property laws.
Purchasing software does not transfer ownership of the software or its underlying intellectual property.
You may not reproduce, publish, distribute, sell, or commercially exploit our website content, software, documentation, or other protected materials except as permitted by these Terms or applicable law.
Feedback and Suggestions
We welcome product ideas, Workshop votes, suggestions, bug reports, and other feedback.
If you voluntarily submit feedback or suggestions to Escapement Tools, you agree that we may consider, develop, use, adapt, or implement those ideas without creating an obligation to compensate you or to build any particular feature or product.
A Workshop vote, suggestion, prototype, preview, or development announcement is not a preorder or a promise that a product or feature will be released.
Acceptable Use
You may not use our website, software, licensing systems, or services to:
Violate applicable law
Attempt unauthorized access to systems or accounts
Introduce malware or other harmful code
Interfere with the operation or security of our services
Fraudulently obtain, copy, share, or circumvent software licences
Impersonate another person or business
Use automated systems in a manner that places unreasonable load on our services
We may restrict access where reasonably necessary to protect customers, our systems, our intellectual property, or the security of our services.
Third-Party Services
Our website and services rely on third-party providers, which may include Squarespace, payment processors, Microsoft Azure, email providers, Autodesk products, and other technology services.
Their products and services are governed by their own terms and policies.
We are not responsible for third-party services that are outside our reasonable control.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, our website, software, and services are provided on an “as available” and “as is” basis.
We do not warrant that every product will be uninterrupted, error-free, compatible with every drawing or environment, or suitable for every particular purpose.
We do not exclude warranties or statutory rights that cannot legally be excluded.
Limitation of Liability
To the maximum extent permitted by applicable law, TD Cadworks Inc. and Escapement Tools will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, business opportunity, productivity, data, or project information arising from the use or inability to use our website, software, or services.
To the maximum extent permitted by law, our aggregate liability relating to a purchased product will not exceed the amount you paid to us for the product giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.

Changes to These Terms

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory rights you may have under applicable consumer law, disputes relating to these Terms will be subject to the jurisdiction of the courts of Alberta, Canada.
Nothing in these Terms waives or limits consumer protections that cannot legally be waived.
